THE POSITIVE RECOMMENDTION OF JUSTICE TALWAR
AWAKE! ARISE!! AGITATE!!!
On 12.02.07 the CHQ received a letter from the Directorate sent by Shri Harinder Singh, Member (P), vide D.O. No.F.6-1/2006-PE.II (Pt ) in which it was mentioned that the Dept had already appointed a GDS Committee to look in to the grievances of GDS employees. The Committee is headed by a Chairman and Sri A.K. Sharma, DDG (Estt.) is functioning as the Member Secretary it is not revealed the name of Chairman of the Committee.
Thus the Dept. has decided to negate our request in formation of judicial committee for gds demands we are demanding the same only in order to revive and review the positive recommendation of Justice Talwar Committee which is the Magna corta of GDS workers. It we desires equality with Govt. staff, Pensionery benefits, regularisation, better service conditions, the recommendation of the justice Talwar Committee should not be buried by the subsequent committee appointed for this purpose.
We should fight against the move of the Dept. and I Placed the same before the Secretariat of NFPE ON 14.02.07 in which all in one voice decided to launch immediate agitation. The secretary General FNPO has also come forward to issue joint call for our cause.
It is therefore decided to call upon all the Divisions/Branches of all the affiliated unions of NFPE& FNPO to send the following Telegrams immediately.

Indefinite Strike
The Postal Joint Council of Action Comprising NFPE and FNPO and its affiliated Unions met on 24th January, 2007 and 11th Feb, 2007 elaborately discussed the attacks on services and staff by the Heads of Circles with regard to abolition of offices, merger of Divisions, non filling up of vacant posts and extension of Screening Committee and formation of Judicial Committee for GDS and reduction of TRCA etc. vindictive actions and victimizations etc. Although these arbitrary actions of Heads of Circles of Andhra, Tamil Nadu, Karnataka, M.P., Jharkhnd etc. had been brought to the notice of the authorities at the Directorate, no tangible results are forthcoming. In view of these unilateral actions of the Postal authorities, the Postal JCA has unanimously decided to launch phased programme of action culminating in an indefinite strike during March, 2007. The action programme decided is as given below:
Campaign Programme 13-02-2007 to 22-02-2007
Dharna at Regional Circle & Directorate 23-02-2007
Campaign & Propaganda26-02-07 to till we go for indefinite strike.
Indefinite Strike Charter of Demands
1. Appointment of Judicial Committee/Commission for G.D.S. and grant Status and Pension to GDS employees. Protection of TRCA
2. Exempt Department of Posts from the purview of reduction of staff strength and fill up all vacant posts in all cadres in Postal/ RMS /MMS / Circle / Regional Offices / Postal Accounts and GDS, including residual vacancies.
3. Drop Franchising of Postal Outlets Scheme, Stop closure of Post Offices / RMS Offices Transit Sections/Relocation & merger of office and Division, stop combination of beats of Postmen/Stop Curtailment of Postal deliveries, Outsourcing of PAO functions etc.
4 Ensure monopoly of collection, conveyance and delivery of letter mail by the Department of Posts as recommended by the Parliamentary standing committee.
5. Regularise casual Labourers / Full Time / Part Time Contingency paid.
6. Filling up of all Norms based LSG I HSG II, HSG-I posts.
7. Encashment of all pending bills OTA / TA / Medical / RPLI Commission etc.
8. Grant Compassionate appointments to eligible candidates and absorb all approved candidates.
9. Complete take over of POSB and PLI by the Postal Department and accord full Autonomy to the Postal Board as in the case of Railway Board.
10. Recognition of Federations and setting up of councils at all level.
Meeting with Secretary (Posts)
The NFPE leaders comprising Comrades C.C.Pillai, K. V.Sridharan, Giri Raj Singh, P. Suresh, P. Rajanayagam and S.S. Mahadevaiah met Shri I.M.G.Khan Secretary (Posts) on 12 Feb 2007 at 1 p.m. The issues of appointment of Judicial Committee for GDS, Exemption of Dept of Posts from the purview of reduction of staff strength; Drop franchising of Postal Outlets Scheme etc. were strongly raised before the Secretary (Posts). Also M.P. Circle and Jharkhnd circle problems. The Circle Unions brought notice that the Heads of Circles are ordering closure of offices, merger of Divisions, outsourcing Postal functions through franchisee Postal outlets, RPLI targets etc. The Heads of Circles are implementing all these dismantling activities without discussing with the staff side. This has generated serious resentment among the entirety of Postal Employees.
The other news I developments relating to various issues in the department are furnished hereunder for your information.
1. The syllabus of LGOs Exams is under revision.
2. The vacancies kept pending under residual vacancies may be filled up by the respective circles which will not be objected by the Directorate. Circle Secretaries, please act swiftly.
3. The relaxation of rules and permitting plus two qualified GDS officials to write the
Postal Assistant examination is yet to be approved by the Law Ministry reminded.
4. The Cabinet Note with regard to exemption of Postal Department from the purview of Screening Committee & Ban on creation is still pending approval of the Minister of Communications. The Directorate contacted the PA to Hon'ble Minister and expedited the file. Hope this will be moved faster.
5. During discussions with the Secretary Shri I.M.G. Khan today, he consented to consider to take the GDS services like atleast 3 years as 1 year as qualifying service for the grant of pension. He assured to send proposal.
6. Regarding the formation of Judicial Committee for consideration of GDS demands, once again the file was sent to the Minister of Communications for decision.
Franchisee Postal outlets:
Meanwhile the Department of Posts issued Orders on franchisee Postal outlet which is nothing but outsourcing the Postal functions vide DGP NO. 40-36/EFC/04-Plg Dated 8-02-2007.All Circle/Divisional/Branch Secretaries are requested to take necessary steps at local level and take immediate action together with our other sister Unions, to arrest the implementation of franchisee Postal outlets.

Dear Comrades & Friends,
It has been intimated to Com. S.S. Mahadevaiah, General Secretary, All India Postal Extra Departmental Employees Union by the Dept. of Posts vide D.O. No. F-6-1/2006-PE-II (Pt) dated 12th February 2007 that they have already appointed a GDS Committee to look in to grievances of GDS employees. The Committee is headed by a Chairman and Shri AK Sharma DDG (Estt) as Member Secretary. It is not revealed the name of chairman.
The postal JCA had decided to observe protest demonstration at all work places immediately and send telegrams to the Hon’ble Minister(C) and Director General (Posts) demanding immediate setting up of Judicial Commission for GDS. The Commission / Committee headed by any retired / serving Officers will not be accepted by the employees.
The JCA call upon all Circle/Divisional / Branch Secretaries of NFPE & FNPO to sent following telegrams immediately with a copy to respective Unions / Federations.

Dear Comrades,
The Federal Secretariat meeting of the National Federation of Postal Employees was held on 13th & 14th February 2007 .The Department of Posts had communicated to Com. S.S. Mahadevaiah General Secretary, AIPEDEU, vide D.O. No. F.6-1/2006-PE-II(Pt) dated 12th February , 2007 that the Dept. had already appointed a GDS Committee headed by a Chairman and Shri A.K. Sharma , DDG (Estt.) as Member Secretary. The letter did not reveal the name of the Chairman.
The Postal JCA had decided to observe protest demonstration at all work places immediately demanding setting up of Judicial Committee for GDS early and to send telegrams to the Hon’ble Minister (C) and DG (Posts). Post Card campaign by all staff members may also be organized. The JCA Circular is forwarded herewith for implementation by all concerned.
· Campaign & Dharna: The Campaign & Propaganda programme among the employees and public may be effectively implemented at all Circle / Divisions.
· Dharna- on 23rd February, 2007: All Circle / Divisional / Branch Secretaries are to ensure massive participation in the Dharna before PMsG / CPMsG Offices on 23rd February, 2007 demanding settlement of ten point Charter of demands. The Delhi Circle Unions will hold Dharna before the Directorate. They have decided to mobilize more than 1500 employees.
· Strike during April 2007: The Postal JCA met on 9th February 2007 and decided to launch indefinite strike for settlement of the ten-point charter of demands. The strike will commence on 24th April 2007.
· National Postal JCA : will meet in Delhi on 22nd February , 2007 to review the agitational programmes decided by the Postal JCA.
· National Pension Protection Day: The Confederation of Central Government Employees & Workers, All India State Government Employees Federations & All India Defence Employees Federation have jointly decided to organize nationwide joint procession and submit memorandum to the Governors and massive Dharna at Delhi on 7th March, 2007 at Jantar Mantar between 11 AM to 3 PM demanding withdrawal PFRDA Bill.
· Com. N.J. Iyer, Remembrance Day: The Seventh Death Anniversary of Com. N.J. Iyer, Ex. President of NFPE was observed on 13th February 2007 at 3 P.M. in NFPE Office. Comrades C.C. Pillai, SG NFPE, Des Raj Sharma, Dy. GS NFPE & GS P-IV, Com. K.V. Sridharan, GS P-III, Com. Giri Raj Singh GS R-III, Com. K.K. Sharma, Treasurer R-IV, Com. P. Rajanayagam, GS AIPAEA and Com. S.S. Mahadevaiah GS ED Union and other leaders spoke and paid floral tributes to the departed leader. Com. S.P. Mukherjee presided over the meeting.
· Miss. Yoko Ogawa, Leader of UNI Tokyo Office: visited NFPE Office at 2.30 P.M. on 13th February, 2007 , She was enquiring about the union and its activities and reforms activities of the Government in the Postal sector. She was apprised of the developments in the Dept. of Posts by Com. C.C. Pillai, S.G.
· Oral Evidence Before 6th C.P.C. for Unions: Oral Evidence before the 6th C.P.C. for unions affiliated to NFPE are slated to be held on 6th March, 2007 at the Office of the CPMG Chennai.
· R-IV AIC: All India Conference of AIRMS & MMS EU Mailguards & Gr. ‘D’ is scheduled to be held at Salt Lake Stadium, Kolkata from 13th to 15th March 2007.
· C.W.C P-IV: Central Working Committee Meeting of AIPEU Postmen & Gr. ‘D’ is scheduled to be held at Thane, Maharashtra from 24th to 26th March 2007.
· Postmen Pay Scale: AIPEU Postmen & Gr. ‘D’ CHQ is filing the case in Supreme Court on 17-02-07 for grant of upgraded pay scale of Rs. 3050-4590 of Postmen from 01.01.1996.

Confederation meeting on 06-02-2007
The National Executive Meeting of the Confederation of Central Government Employees and Workers has been held at New Delhi on 06-02-2007 at 11 :00 AM. After having a lengthy discussions on various issues like submission of memorandum to 6th Pay Commission, review of the 14th December 2006 strike, delay in grant of interim relief, non formation of Judicial Committee to consider the problems of GDS etc., it was unanimously resolved to hold Dharna on 20-03-2007 throughout the country and the prolonged agitation (strike) programme in May 2007 preferably in the third week.

SUBJECT: INITIAL LAUNCH OF THE FRANCHISING SCHEME IN SPECIFIEDURBAN AREAS.
In consonance with the 10th Plan policy imperatives, an innovative method has been conceived by the Department for providing better access to postal counter services by opening franchised outlets in areas where a post office cannot be opened as per departmental norms. The scheme has been approved by the Hon 'ble MoC & IT for launch. This scheme also figures in the Prime Minister's Thrust Areas. The scheme has been launched through DOG (E&PN) d.o. letter of even number from 1.2.07 in 100 identified locations of specified Circles. The following orders are hereby issued for immediate implementation of the scheme.
2. Details of the Scheme
( I ) Introduction
The Department of Posts is entrusted with the Universal Service Obligation of increasing access to basic postal facilities throughout the country. Even though India has the largest postal network in the world. With over 1.55 lakh post offices. including 89% in the rural area. There continues to be a demand for post offices. Post offices in the rural area are incurring more than the permissible level of loss. In the urban area. Where a minimum of 5 % profit is required as per norms. over 50% of the single and double handed offices are incurring losses. There is a clear need to reduce the deficit while increasing access to post office facilities.
Under the 10th Plan the Department is required to rationalize the network and explore new viable avenues for expansion of its network. The objective is to optimize the resources with a view to achieving self sufficiency while continuing to fulfill the Universal Service Obligation. There is a constant demand from customers to open more post offices especially in newly developing urban agglomerations.
(2) Basic features of the urban franchise model
2.1. Only counter services are to be franchised, while delivery and transmission will be continued through the Department Linking arrangements for the franchised outlets will be provided by the franchisee.
2.2. The franchisee will provide service across the counter for a minimum defined time schedule with flexibility to work round the clock.
2.3. Products and services offered:
l. Sale of stamps and stationery.
2. Booking registered articles, speed post articles, money orders (on EDBO model). e-post, etc. (no bulk booking to be taken up in franchised outlets).
3. Functioning as an agent for PLI and provide related after sales service. Including collection of premia. (subject to fulfillment of criteria for PLI agents)
4. Marketing products for which the Department has a corporate agency or tie-up and provide related follow up services. (Subject to agreement with the other organizations involved)
5. Providing retail and bill/tax /fine collection/payment services of the Department. (Subject to agreement with the other organizations involved)
6. Facilitating the provision of e-governance and citizen centric services (subject to agreement with the other organizations involved)
7. Any other service introduced by the Department in future through its outlets which is considered amenable to the franchisee model. (Subject to agreement with the other organizations involved)
The model has adequate flexibility built in to allow a range of services to be extended through the outlets according to the need/ demand, and to increase the range when found necessary. Thus, the range of counter services that can be offered through different outlets can vary, keeping in view the location and its capacity to generate revenues.
2. 4 Implementation Strategy:
In the initial phase and for the present, the urban franchise model will be implemented only in fast developing areas of urban growth like metros and their satellite towns. as also such urban areas where there is a justification for post offices on the distance and population norms but there is difficulty in providing the same through redeployment. The further extension of the scheme can be taken up after the results available from experience of the initial phase - say after six months of initial launch.
2.5 Viability:
The viability of each franchise only requires to be assessed by the concerned field unit so as to ensure adequate returns to the franchisee. The expected minimum revenue. would depend on the range of services, particular location, potential revenue, the investments that the franchisee is willing to make, the cost likely to be incurred by the Department in providing support facilities, etc.
2.6 Criteria for Selection:
Applicants for franchises would need to submit an application in a prescribed proforma (Annex-I). The selected franchisee will sign a Memorandum of Agreement with the Department (Annex II). Criteria for selection have been fixed considering the need to select persons with the capacity to manage and market a range of products, along with' a sense of the community needs and public aspects of the job, and willingness to accept technological options. The criteria are as below:
(i) Only individuals are eligible for appointment and not any organization which he/ she may be serving/ representing.
(ii) Age: Above 18 years. No upper age limit.
(iii) Educational qualifications: 10+ 2 standard or 12th class pass of a recognized University or Board of School Education or Board of Secondary Education.
(iv) Preference:
a. Postal pensioners
b. Those able to provide computer facilities.
(v) Premises: Proper appropriately located and accessible premises. properly maintained with suitable display of approved signages.
(vi) Applicant should be wining to make the necessary investments for the conduct of the business and be able to provide a simple business plan comprising details of how. the premises win be run, what the opening hours would be, investments proposed. market conditions, proposals for marketing products, awareness of customer base. Role in local community, budget, finances, etc. Two references from respectable persons of the locality where the franchise is proposed to be located would also be required to establish the character and antecedents of the applicant.
(vii) A business plan would be prepared taking into account the anticipated minimum level of business/ revenue worked out by the Divisional Head for the specific franchise.
(viii) Security Deposit: The security deposit to be provided by the franchisee would be based on the maximum possible level of financial transactions likely be undertaken by the franchisee in a day. The minimum security deposit would be Rs. l 0.000 the shape of a performance bank guarantee.
(ix) Selection: Would be made by a committee comprising the Heads of the concerned Division and a neighboring Division. based on a report from the ASP/SDI.
2.7 Remuneration to franchisee:-
The franchisee will earn remuneration commission on services provided. as set out in the Schedule of Memorandum of Agreement.
(3) Monitoring
The monitoring mechanism for the scheme will be strengthened vis-a.-vis regular outlets. with monthly monitoring by inspectors. An element of electronic monitoring will be introduced in due course.
(4) Training
Introduction to the objectives, products/ services, basic procedures, upkeep of the premises and customer care would be part of induction training of the franchisee. The briefing will be done by the sub-divisional inspector of the area.
(5) Branding of franchisee outlet
Standard signages for India Post franchisee would be provided to give a uniforJ11 look to all franchised outlets. Signage design is at Annex - III.
3. The operating manual for franchised outlets in urban areas is at Anpex-IV. Accounting procedure for remuneration is at Annex- V.
4. This issues with the approval of competent authority. The scheme is required to be implemented in 100 identified urban locations by 31/3/2Q07.

Dear Comrades,
The Federal Secretariat meeting of the National Federation of Postal Employees was held on 13th & 14th February 2007 .The Department of Posts had communicated to Com. S.S. Mahadevaiah General Secretary, AIPEDEU, vide D.O. No. F.6-1/2006-PE-II(Pt) dated 12th February , 2007 that the Dept. had already appointed a GDS Committee headed by a Chairman and Shri A.K. Sharma , DDG (Estt.) as Member Secretary. The letter did not reveal the name of the Chairman.
The Postal JCA had decided to observe protest demonstration at all work places immediately demanding setting up of Judicial Committee for GDS early and to send telegrams to the Hon’ble Minister (C) and DG (Posts). Post Card campaign by all staff members may also be organized. The JCA Circular is forwarded herewith for implementation by all concerned.
· Campaign & Dharna: The Campaign & Propaganda programme among the employees and public may be effectively implemented at all Circle / Divisions.
· Dharna- on 23rd February, 2007: All Circle / Divisional / Branch Secretaries are to ensure massive participation in the Dharna before PMsG / CPMsG Offices on 23rd February, 2007 demanding settlement of ten point Charter of demands. The Delhi Circle Unions will hold Dharna before the Directorate. They have decided to mobilize more than 1500 employees.
· Strike during April 2007: The Postal JCA met on 9th February 2007 and decided to launch indefinite strike for settlement of the ten-point charter of demands. The strike will commence on 24th April 2007.
· National Postal JCA : will meet in Delhi on 22nd February , 2007 to review the agitational programmes decided by the Postal JCA.
· National Pension Protection Day: The Confederation of Central Government Employees & Workers, All India State Government Employees Federations & All India Defence Employees Federation have jointly decided to organize nationwide joint procession and submit memorandum to the Governors and massive Dharna at Delhi on 7th March, 2007 at Jantar Mantar between 11 AM to 3 PM demanding withdrawal PFRDA Bill.
· Com. N.J. Iyer, Remembrance Day: The Seventh Death Anniversary of Com. N.J. Iyer, Ex. President of NFPE was observed on 13th February 2007 at 3 P.M. in NFPE Office. Comrades C.C. Pillai, SG NFPE, Des Raj Sharma, Dy. GS NFPE & GS P-IV, Com. K.V. Sridharan, GS P-III, Com. Giri Raj Singh GS R-III, Com. K.K. Sharma, Treasurer R-IV, Com. P. Rajanayagam, GS AIPAEA and Com. S.S. Mahadevaiah GS ED Union and other leaders spoke and paid floral tributes to the departed leader. Com. S.P. Mukherjee presided over the meeting.

Yoko Ogawa, Leader of UNI Tokyo Office: visited NFPE Office at 2.30 P.M. on 13th February, 2007 , She was enquiring about the union and its activities and reforms activities of the Government in the Postal sector. She was apprised of the developments in the Dept. of Posts by Com. C.C. Pillai, S.G.
· Oral Evidence Before 6th C.P.C. for Unions: Oral Evidence before the 6th C.P.C. for unions affiliated to NFPE are slated to be held on 6th March, 2007 at the Office of the CPMG Chennai.
· R-IV AIC: All India Conference of AIRMS & MMS EU Mailguards & Gr. ‘D’ is scheduled to be held at Salt Lake Stadium, Kolkata from 13th to 15th March 2007.
· C.W.C P-IV: Central Working Committee Meeting of AIPEU Postmen & Gr. ‘D’ is scheduled to be held at Thane, Maharashtra from 24th to 26th March 2007.
· Postmen Pay Scale: AIPEU Postmen & Gr. ‘D’ CHQ is filing the case in Supreme Court on 17-02-07 for grant of upgraded pay scale of Rs. 3050-4590 of Postmen from 01.01.1996.

The National Executive Meeting of the Confederation of Central Government Employees and Workers has been held at New Delhi on 06-02-2007 at 11 :00 AM. After having a lengthy discussions on various issues like submission of memorandum to 6th Pay Commission, review of the 14th December 2006 strike, delay in grant of interim relief, non formation of Judicial Committee to consider the problems of GDS etc., it was unanimously resolved to hold Dharna on 20-03-2007 throughout the country and the prolonged agitation (strike) programme in May 2007 preferably in the third week.
